Public Bodies ~ Requirements effective July 29, 2010
Public bodies are required to maintain a Notice of Public Meeting section on their website for future posting of notices. This area will list the physical and electronic locations of Notices of Public Meetings. The intent is this section will create transparency in government notices so the public will know where each is posted, even if no public meetings are scheduled. When a notice of public meeting is released by a public body, the notice shall be publicized on this area of their website. As with any public record, public bodies are required to maintain and archive all public meeting notices per their records retention schedule.
The law does not prevent public bodies from posting open meeting notices in other locations if desired and public bodies are encouraged to do so. For example, public bodies may still post a paper version of the open meeting law in their main lobby and/or post the notice on the Department of Administration's website. Remember, if public bodies posts notices elsewhere, they should also include the other physical and electronic locations on the "Notice of Public Meeting" section of their website.
If a public body does not have a website they are still required to post open meeting notices. Review Chapter 88 for more information.
